Consider the French Resistance in 1942.  So far as the German were concerned they were "terrorists".  One of the "organisers",  named "White Mouse" by the Germans,  was in fact a NZ woman,  a Maori.  In modern parlance that would put her in the same "category" as the insurgents in Iraq. 

Because the allies "won" WW2 they are counted as heros.

Much of the current debate is about justifying revenge,  not the application of justice and punishment.  

The question really should be -

&lt;b&gt;"Do we treat and detain our opponents with justice and humanity in accordance with our sense of "civilisation";  or do we treat them according to our interpretation of the rules irrespective of how inhumane the consequences?"</description>
