Oh, for crying out loud....nothing like taking this statement out of context! Why don't you indicate the entirety of the circumstances and statements? And, yes I went to your site and read your full post.

BBC News: 7-2-05

Even as George W. Bush, the U.S. President, appealed for a "dignified" Senate confirmation process for Justice O'Connor's replacement, Senate Democrats were vowing to oppose any presidential nominee they considered too ideologically conservative. [i.e. read Scalia or Thomas]

"If the President abuses his power and nominates someone who threatens to roll back the rights and freedoms of the American people, then the American people will insist that we oppose that nominee, and we intend to do so," said Senator Ted Kennedy of Massachusetts, a member of the judiciary committee that will vet Mr. Bush's Supreme Court nominee.

"I will not vote for someone unless they demonstrate a core commitment to the fundamental constitutional values of the Constitution, including privacy."

Salon: 7-02-05

Saying, "I have voted for judges that have been pro-life," Kennedy promised not to apply a so-called abortion litmus test. But it remains unclear how Democrats will view any candidate that is outspokenly opposed to the federal right to abortion.
